We acted for the Client as a customer in a legal dispute arising out of a bank guarantee securing the contractor’s obligations to construct a complex for the development of one of the largest potash deposits in the Republic of Belarus.
After receiving payment under the bank guarantee, the contractor filed a claim with the international arbitration court to recognize part of this payment as unjustified enrichment. This claim was satisfied by the court, after which the contractor filed a similar claim for the remaining amount of funds paid under the bank guarantee. In this case, we managed to achieve a rejection of the claim, despite the existence of a previous court decision satisfying the claim.
