Representing a client in a major competitive dispute

The plaintiffs, two foreign companies representing a large foreign retail chain, filed a lawsuit against our client in a foreign court, seeking compensation of losses in the amount of almost EUR 300 million due to the client’s alleged illegal use of the opponent’s retail chain concept in the territory of the Republic of Belarus, intellectual property rights, which, according to the plaintiffs, prevented their entry into the Belarusian market and caused them damage.

We represented the client’s interests in this case, advised on the legal position, conducted an assessment from the point of view of Belarusian legislation, assisted in the development of a judicial strategy, formation of the evidence base, elaborated and implemented the strategy aimed at changing the jurisdiction over the dispute and refusing to execute the foreign court’s letters rogatory, etc.
