We represented the client in its complex cross-border dispute with the Italian company Eliopig S.r.l. (contractor for the construction of plants and systems for livestock farms), arising in connection with the contractor’s improper performance of the construction contract under which an advance payment of EUR 3.5 million secured by the bank guarantee was made. We represented the client’s interests in the economic court of Minsk region during consideration of its claim for termination of the construction contract.
Having achieved a favorable decision, together with Italian lawyers we developed judicial tactics and strategy, prepared service documents for consideration of the case and provided litigation support in Italian courts on disputes related to the contractor’s challenge of the bank guarantee, under which the customer demanded the return of the paid advance payment.
