Successful legal defense of a Turkish company against a prosecutor’s claim

A Turkish construction company providing conceptualization, design, engineering and construction services constructed a hotel in Minsk for a Belarusian customer. Upon completion of the construction, the prosecutor brought a claim against the client in support of the customer to recover USD 1.5 million of liquidated damages due to the delay in the construction of the facility.

In fact, we managed to win this case, as the court eventually awarded a payment of USD 5,000, which turned out to be three hundred times less than the claimed amount.

We developed the judicial strategy and tactics in this case, prepared service documents and represented the client in court.
